Digital Explorers Terms and Conditions of Service

These Terms and Conditions are an agreement between you ("you") and The Motley Fool Australia, Pty Ltd ("The Motley Fool," "Fool Australia," or "we"), PO Box 104, Isle of Capri, Qld 4217, by which we provide you access to our portfolio, Motley Fool Australia Digital Explorers (the "Service"). By subscribing to, and using the Service you are agreeing to be bound by all applicable terms and conditions.

Prior to subscribing, please review our Financial Services Guide (FSG). By subscribing to and using the Service, you specifically acknowledge that you have received, read and understood our FSG.

The Digital Explorers Portfolio; Operating Rules

Motley Fool: Digital Explorers is a real-money portfolio in which The Motley Fool invests $100,000 in digital assets over the span of 12 months in a biweekly rhythm. We aim to invest in the most promising digital assets for the next five years — which is our targeted average holding period.

This Service recommends investing in cryptocurrency and other digital assets. There is question amongst several jurisdictions and regulatory authorities as to whether cryptocurrency is a security. The Motley Fool cannot provide advice on the treatment of cryptocurrency as a security and recommends that investors check with their personal financial advisors to see if investing in cryptocurrency is right for their own financial situation. Cryptocurrency trading involves high risk and is not suitable for all investors. Before deciding to trade cryptocurrencies, tokens, or any other digital asset, you should carefully consider your investment objectives, level of experience, and risk appetite. The possibility exists that you could sustain a loss of some or all of your initial investment, and therefore, you should not invest money that you cannot afford to lose. Additionally, any recommendations on cryptocurrencies are not currently considered securities, and therefore may fall outside of the Australian Financial Services License- General Advice that The Motley Fool Australia holds. Purchases of this product are done knowing and assuming these risks.

The Service will recommend a collection of cryptocurrencies up front and later send occasional updates about those or other cryptocurrencies and other digital assets, and may include ongoing coverage or additional recommendations. As a subscriber, you will be entitled to view the portfolio upon the release of each section, and in its entirety after the rollout period, for the term of your membership.

The Service will wait at least one full market day after the portfolio has been released to members and buy alerts have been issued to transact in those securities.

From time to time The Motley Fool may change the features and offerings included in the Service, but we will provide you with advance notice of any material changes to the Service and/or your membership. You may terminate your membership at any time pursuant to the terms and conditions of your subscription.

All services and features provided by Motley Fool Australia Digital Explorers are provided "AS IS." The Motley Fool assumes no responsibility for the timeliness or delivery of any content or the deletion or failure to store any personalised or customised settings.

Warning – General Advice Only

This service involves the recommendation of cryptocurrencies, and any recommendations on cryptocurrencies are not currently considered securities therefore may fall outside of the Australian Financial Services License- General Advice that The Motley Fool Australia holds. Purchases of this product are done knowing and assuming these risks.

The Service may use a mix of investing strategies within the portfolio. Regardless of the action taken by the Service, it is in the capacity of a responsible investor and not a speculator. That doesn't mean our trades will always turn out to be winners. It means that we have done our best to do our homework and consider the inherent risks before pledging our money. We urge you to do the same.

We want to help you make money. We also want to provide you with a more enriching and useful experience along the way. So while we may ask you a few questions to help direct you to portfolios and other content we think may interest you, The Motley Fool is not in the business of rendering personalised or individualised investment advice. We don't (and can't) know your financial situation, risk tolerances, or investing objectives. Accordingly, the information provided along with the decisions made and actions taken by the Service do not constitute a recommendation that a particular portfolio, security, strategy or action taken is suitable for you, or any specific person for that matter.

The Service bases its recommendations and forecasts on techniques, information and sources believed to be reliable in the past and cannot guarantee future accuracy and results. The Motley Fool and the writers will not be liable for any investment decision you make, or action you take based upon reliance of any material you read here. Portfolio Performance

The Service's returns reflect the gains and losses of its real money portfolio. The returns are based on the percentage change between the cryptocurrency or digital asset price at the time we bought the asset and the current or sell price (if the position has been closed) at the time of the transaction. Brokerage, taxes and any other associated costs are not taken into account. The returns displayed are not net of fees.

Please remember that investments, including cryptocurrencies, can go up and down. Past performance is not necessarily indicative of future returns. Performance figures are not intended to be a forecast and we do not guarantee the performance of, or returns on any investment.

Subscription, Payment; Automatic Renewal

The Service is available only by subscription, meaning that you sign up for a set term by confirming your order and paying the applicable membership fee (the "Service Fee").  All Service Fees are non-refundable, except as required by Australian Consumer Protection statutes. All Service Fees are due in advance. Regardless of initial term, your subscription will automatically renew for one year terms, after the expiration of the initial term, until you notify us of your decision to terminate your membership. Accordingly, you agree that your Service Fee will be billed automatically at the beginning of each renewal period and except as expressly provided in these terms, any Service Fee paid hereunder is non-refundable except as required by Australian Consumer Protection statutes.

Currently, you can pay for your subscription via credit card or PayPal. If you indicate that you wish to pay via PayPal, you will be transferred to the PayPal website to complete the purchase. Please note that once on the PayPal site you are subject to PayPal's policies and terms of service, which are completely outside of The Motley Fool's control.

Prices published on Fool.com.au are quoted in Australian dollars and are inclusive of GST and all other duties and taxes, as required by law. The Motley Fool cannot issue refunds or withhold from your Service Fee any amounts for GST. If you think you are entitled to a GST refund, please contact the Australian Tax Office.

The Motley Fool reserves the right to increase the Service Fee or institute new 

charges upon reasonable notice.

Trial Periods and Cancellation

On occasion, the Service may provide a trial offer. Only one such trial may be taken per household and per email address at any given point in time. In addition, there is a limit of one trial per person and per email address in any six-month period unless otherwise stated in the offer. You will be charged up front for your membership, via the payment method you provide.

You may cancel your subscription at any time by contacting [email protected]. If you cancel your subscription within 30 days of renewal, you will receive a full refund for the applicable term. Except as expressly stated in these terms, after this 30-day period, all fees are non-refundable except as required by Australian Consumer Protection statutes. Also, under our Anti Money Laundering procedures, Fool Australia will not issue you a refund totalling more than $5000 in any six-month period without additional verification as to your identity.

Please note: once a subscription is cancelled, you will no longer have access to any of our content including without limitation past recommendations, articles and special reports. You acknowledge and understand that any material you wish to retain must be downloaded or printed prior to termination of your subscription. Any such downloaded or printed content is subject to the Intellectual Property provision below. Otherwise, you lose the right to do so.

Access to the Service

If you are a first-time subscriber, you will need to provide Fool Australia with your name, email address, and billing and shipping addresses. You certify that all information you provide is accurate. You also agree to maintain and update your information as necessary so that it remains accurate and current. If any information you provide is inaccurate or not up-to-date, The Motley Fool reserves the right to cancel your subscription.

You will also be asked to create a password. You will need this password in order to access the Service. The Service should only be accessed by paid Fool Australia members. Accordingly, you agree not to forward any Service-related content to any third party without Fool Australia's written permission.

Disclaimer

The Service bases its recommendations and forecasts on techniques, information and sources believed to be reliable in the past and at the time of publication. However, The Motley Fool does not warrant the completeness or accuracy of the information presented. We make no promises that the Service will be delivered to you on an uninterrupted, timely, secure or error-free basis. To the maximum extent permitted by law, Fool Australia, its affiliates and their respective directors, officers and employees disclaim any liability for any loss or damage arising from any action taken by you and/or other based on the use of, or reliance on the information provided we publish. If the law prohibits this exclusion, Fool Australia hereby limits its liability, to the extent permitted by law.

Modification or Discontinuation

The Motley Fool reserves the right to modify, suspend or discontinue all, or part of the Service. In the event we discontinue the Service, you agree that we may transfer your subscription to another Fool Australia service of equal or greater value. Without limiting any of the foregoing, you agree that if this Service is discontinued, The Motley Fool's only obligation to you is to provide you with a pro-rated refund, at your request.

Intellectual Property

Our Content is protected by Australian and international copyright, trademark and other intellectual property laws and is the property of Fool Australia and/or providers of the Content under licence. "Content" means any information, mode of expression, or other material found published by Fool Australia including without limitation our recommendations, writings, graphics and all other features.

All Content is intended for individual, non-commercial use only. You may download or print one copy of any material. Any other copying, distribution, storing, transmission or re-dissemination of any kind, is prohibited without The Motley Fool's prior written permission. Aside from opening yourself up to liability, distributing our Content to other sites and individuals is unfair to our members who pay good money to receive our Content. So please don't do it.

Privacy

All personal data you provide to Fool Australia is maintained in the United States of America. By subscribing and using the Service, you consent to our transferring and handling the data under the terms of our Privacy Policy, which is incorporated by reference.

If you are using PayPal to pay for your subscription, PayPal is processing payment and we do not have access to your credit card information. Accordingly, you agree that Fool Australia has no responsibility or liability for PayPal's privacy practices.

Changes to these Terms and Conditions

We may change these terms at any time, but we will post a notice on the Service's website of any material changes. Your continued use and access of the Service means that you accept any new or modified terms.

General Information

If any part of this Agreement is invalid or unenforceable, the remaining provisions will continue in full force and effect.

These Terms and Conditions are governed by and interpreted in accordance with the laws of the State of Victoria, Australia.
