Subscription Terms of Service

Welcome to Motley Fool Hidden Gems (the “Newsletter”), the newsletter brought to you by The Motley Fool Australia Pty Ltd (“The Motley Fool,” “Fool Australia,” or “we”), PO Box 4635, Ashmore, Qld 4214.  These Terms and Conditions are an agreement between you (“you”) and Fool Australia, regarding your subscription to the Newsletter.  By subscribing to and using the Newsletter you are agreeing to be bound by all these terms and conditions.

Prior to subscribing, please review our Financial Services Guide (FSG).  By subscribing and using the Newsletter, you specifically acknowledge that you have received, read and understood our FSG.

General Advice Only

The Newsletter provides recommendations for buying and selling shares of publicly traded companies. As stated in our FSG, The Motley Fool (AFSL 400691) provides only general financial advice.  That is, the information contained in the Newsletter has been prepared without taking your personal circumstances into account.

You may email your comments and questions about our coverage and our advisors will endeavour to respond to them in the Newsletter’s weekly update.  We may also email you directly in response to any general inquiries you may have about our services.  Whether our response is via email or made part of Newsletter’s weekly update, we will not (and cannot) address your particular investment situation and our comments will not constitute advice that a specific security, strategy or action is suitable for you.

You therefore agree that all commentary, statements of opinion and recommendations found in the Newsletter and weekly updates as well as any communication from Fool Australia to you (including in any interactive forums) is general advice only and we have not taken into account your personal objectives, financial situation or circumstances when preparing or providing such information.

The Newsletter and all related content are provided exclusively by Fool Australia.   While we may look at our US parent or UK affiliate publications for international stock ideas, all share recommendations have specifically been adopted by one of the Newsletter’s advisors and provided to you by Fool Australia.  You acknowledge that the general financial advice is provided to you solely by Fool Australia in its capacity as an AFSL holder.

Portfolio Performance 

All Newsletter returns are hypothetical and based on the percentage change between the stock price at the time of recommendation and the current or sell price (if the position has been closed) at the time of publication. Brokerage, taxes and any other associated costs are not taken into account.

Trading and Disclosure Rules

Fool Australia strives to operate with the highest level of integrity and minimize any potential conflicts of interest. With that in mind, all Fool Australia employees and contractors are subject to a code of conduct and rules governing their personal trading activities.  With respect to the Newsletter, employees may not trade based upon any knowledge of an upcoming recommendation by the Newsletter and they must wait at least two full market days after the Newsletter has been published before trading in any recommended security.  In addition, the Newsletter advisors may not make any trades that are inconsistent with the Newsletter’s recommendations (in other words, buy a stock that the Newsletter recommends selling or sell when the Newsletter recommends a buy).

The Motley Fool is a company of investors writing for investors and as such, the writers (and/or the company, its parent or affiliates) may own stocks mentioned by the Newsletter. An affiliate of Fool Australia provides investment products to US investors that may hold securities mentioned in our publications. Editorial personnel have no nonpublic knowledge of the affiliate’s holdings, and the affiliate’s personnel have no knowledge of any editorial content before it is published.

Newsletter Subscription 

When subscribing to the Newsletter, you will need to provide us with your name, email address, and billing and shipping addresses.  You certify that all information you provide is accurate. You also agree to maintain and update your information as necessary so that it remains accurate and current. In the event that any information you provide is inaccurate or not up-to-date, The Motley Fool reserves the right to cancel your subscription.

At the time of subscribing, you will also be asked to create a password.  You will need this password in order to access the Newsletter.  The Newsletter should only be accessed by paid Fool Australia members.  Accordingly, you agree not to forward the Newsletter and any related content to any third party without Fool Australia’s written permission.

Payment; Automatic Renewal

Prices published on Fool.com.au are quoted in Australian dollars and are inclusive of GST and all other duties and taxes.  Currently, you can pay for your subscription via credit card or PayPal.   If you indicate that you wish to pay via PayPal, you will be transferred to the PayPal website to complete the purchase.  Please note that once on the PayPal site you are subject to PayPal’s policies and terms of service, which are completely outside of The Motley Fool’s control.

Subscription fees are due in advance and your membership will automatically renew for the annual or other subscription period you originally signed up for, until you notify us of your decision to terminate your membership.    The Motley Fool reserves the right to increase the Newsletter’s fees or institute new charges upon reasonable notice. Accordingly, you agree that your membership fee will be billed automatically at the beginning of each renewal period at the Newsletter’s then-current rate.

Trial Periods and Cancellation

The Newsletter may on occasion provide a trial offer. Only one such trial may be taken per household and per email address at any given point in time. In addition, there is a limit of one trial per person and per email address in any six-month period unless otherwise stated in the offer.  If you do not cancel your subscription within the trial offer period, your credit card or PayPal account will be charged.

You may cancel your membership at any time and receive a pro-rated refund for the remainder of your subscription term by contacting [email protected].  Notwithstanding the foregoing, under our Anti Money Laundering procedures, Fool Australia will not issue you a refund totalling more than $1000 in any six-month period without additional verification as to your identity.

In the event that we cease publishing the Newsletter, you agree that The Motley Fool may transfer your subscription to another service of equal or greater value. Of course, you may cancel your membership to the new service at any time and receive a pro-rated refund for the remainder of your subscription term.

Access to the Newsletter

Access to the Newsletter is strictly limited to paying members and those individuals with trial offers as set forth in these terms.  You agree not to access this website and the Newsletter by any other means other than through the interfaces we provide for use.  Any materials downloaded in breach of these terms and conditions, remain the property of  The Motley Fool Australia.

The Motley Fool reserves the right to take any necessary action in response to a violation of the above rules.

Intellectual Property

The Newsletter’s Content is protected by Australian and international copyright, trademark and other intellectual property laws and is the property of Fool Australia and/or providers of the Content under licence.  “Content” means any information, mode of expression, or other material found in the Newsletter including without limitation our writings, graphics and all other features.

Our Content is intended for individual, non-commercial use only.   You may download or print one copy of any material.  Any other copying, distribution, storing, transmission or re-dissemination of any kind, is prohibited without The Motley Fool’s prior written permission.  Aside from opening yourself up to liability, distributing our Newsletter to other sites and individuals is unfair to our members who pay good money to receive our Content. So please don’t do it.

Privacy

All personal data you provide us is maintained in the United States of America.  By subscribing and using our Newsletter, you consent to our transferring and handling the data under the terms of our Privacy Policy, which is incorporated by reference.

Because PayPal is processing payment, Fool Australia does not have access to your credit card information.  Accordingly, you agree that Fool Australia has no responsibility or liability for PayPal’s privacy practices.

Changes to these Terms and Conditions

We may change these terms at any time, but we will post a notice of any material changes. Your continued use and access of the Newsletter means that you accept any new or modified terms.

General Information

If any part of this Agreement is invalid or unenforceable, the remaining provisions will continue in full force and effect.

These Terms and Conditions are governed by and interpreted in accordance with the laws of the State of Victoria, Australia.
